Terms of Service

  1. Valid as of 12 September 2026

1. THESE TERMS

  1. 1.1. What these terms cover. These are the terms and conditions on which JustHostMe Limited ('JustHostMe') supply services to you. These terms, together with any applicable order details, service-specific terms, policies expressly incorporated into them and any other documents expressly referred to in them, form the agreement between you and us ('Agreement').
  2. 1.2. Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what to do if there is a problem and other important information.
  3. 1.3. When the Agreement starts. The Agreement comes into effect when we accept your order in accordance with clause 3.1. By placing an order, you confirm that you have read and agree to these terms. If you are placing an order on behalf of a company, organisation or another person, you confirm that you have authority to do so.
  4. 1.4. Changes to these terms. We may update these terms from time to time where reasonably necessary, including to reflect changes to our services, technology, security requirements, legal or regulatory requirements, or to improve or clarify our terms. Where a change materially affects an existing service, we will normally give you at least 30 days' notice by email, unless a shorter period is required by law or is reasonably necessary to address an urgent security, legal or regulatory issue. Changes will not retrospectively alter rights or obligations that have already accrued. Where a change materially affects an existing recurring service, you may cancel that service before the change takes effect if you do not wish to continue under the amended terms, subject to any applicable minimum term or other contractual provisions.
  5. 1.5. Keeping your contact details up to date. You are responsible for ensuring that the email address and other contact information held on your account are accurate and current. We will not be responsible for a communication not reaching you where this is caused by inaccurate or outdated contact information supplied by you.

2. INFORMATION ABOUT US AND HOW TO CONTACT US

  1. 2.1 Who we are. We are JustHostMe Limited, a company registered in England and Wales. Our company registration number is 06356693 and our registered office is at JustHostMe Limited, No. 1 Business Centre, 1-11 Alvin Street, Gloucester, GL1 3EJ, United Kingdom. 3. 2.3 How we may contact you. If we have to contact you we will do so by telephone, email or post using the contact details held on your account. We will never ask for your password. If there are wider service issues or scheduled maintenance, we may alternatively update our status page at justhostme.co.uk/portal.
  4. 2.4 Customer Support
    1. Our standard level of support, response times, and service coverage are described in our Support Scope page. By using our Services, you acknowledge and agree to the support levels set out there.
    2. Support is provided through our ticketing system, live chat, and other channels as outlined in the Support Scope. Response times may vary depending on the nature of the enquiry.
  5. 2.5 Complaints
    1. If you are unsatisfied with the service you have received, you may submit a complaint via our Complaints Policy page. Complaints will normally be acknowledged within 5 business days.
    2. Our Complaints Policy explains our internal escalation process. Nothing in that process prevents you from exercising any statutory or other legal right available to you.

3. OUR CONTRACT WITH YOU

  1. 3.1 How we will accept your order. Placing an order on our website is an offer by you to purchase the relevant service. An order is accepted when we confirm that the order has been accepted or fulfilled, at which point a contract comes into existence between you and us. Payment may be required before a service is activated, depending on the service and the payment terms displayed at the time of order.
  2. 3.2 If we cannot accept or fulfil your order. If we are unable to accept or fulfil your order, we will inform you and refund any money you have paid for the affected service. Examples include where a requested domain name is unavailable, where a registry requires a non-standard price that has not been agreed, or where a requested transfer cannot be completed.
  3. 3.3 Account Details. In order to access our Services you will be asked to create an Account. You may be allocated a username and password when your order is placed. We reserve the right to change credentials where reasonably necessary and will notify you where appropriate. You warrant to JustHostMe that all information submitted in order to set up and utilise your Account is true, accurate and complete. You are responsible for activity carried out through your Account, subject to applicable law and notwithstanding whether such activity was authorised by you. You must keep your login details secure and notify us promptly of any unauthorised use of your account or security breach.

OUR PRODUCTS

4. DOMAINS

  1. 4.1 Domain Registration. We make no representations as to the availability of a particular domain name requested for registration by you (Domain). A Domain will normally be registered in or transferred into the registrant details supplied by you, not in JustHostMe's name. You should manage your Domain registration and contact information through your JustHostMe client area where available. It is your responsibility to ensure that all data is accurate and up to date. Your Domain may be taken offline if required information cannot be verified. To provide the best service we may from time to time change the registrar that a Domain is held with where reasonably necessary. Such a change does not, of itself, affect your domain name usage.
  2. 4.2 For all applicable gTLDs you agree that we will act as a Designated Agent, in accordance with ICANN's applicable Transfer Policy, for requests concerning changes to registrant details. You authorise us to approve a change of registrant where permitted by the applicable policy and your instructions.
  3. 4.3 Checking the registration/renewal. Our role in domain registration and transfer is subject to the rules and systems of the relevant registry. You are responsible for checking that the domain has been registered, renewed and/or transferred as appropriate. We will take reasonable care in processing your order but cannot guarantee that a registry will accept or complete a registration or transfer.
  4. 4.4 Third Party terms and conditions. Domain registration is subject to third-party terms and conditions, including those of the relevant registry and, where applicable, ICANN. By submitting your order to us you confirm that you will comply with those requirements. You will indemnify us against reasonable losses and costs arising from your breach of applicable domain-registration requirements, except to the extent caused by our own breach, negligence or unlawful act.
  5. 4.5 Domain Renewals. We will endeavour to automatically renew a Domain on your behalf when it is due for renewal, save where you have instructed us not to renew it or have set the Domain to cancel or manual renewal in your client area. We will not renew a Domain where payment has not been received as required or where no valid payment method is available.
  6. 4.6 Detail of renewal. Renewals will ordinarily be for the same duration as the initial registration period, unless otherwise stated. The renewal will be charged at the prevailing rate at the time of renewal. Where automatic renewal is enabled and a stored payment method is available, we may attempt to take payment for Domain renewals up to 7 days prior to the Domain renewal date in order to allow sufficient time to complete the renewal.
  7. 4.7 Domain Transfers and Ownership Terms. We may determine the registered domain holder by reference to the details held by the relevant registry. If those details are not determinative, we may request supporting evidence to establish ownership or authority. It is your responsibility to resolve disputes over ownership with a third party. We are under no obligation to carry out a transfer request if we are not satisfied that the correct consents and permissions have been obtained.
  8. 4.8 Basis of Transfer. You are responsible for completing any steps required to transfer the domain, including changing the Nominet IPSTAG where applicable, unlocking the domain name, providing the authorisation code, and approving a transfer request. You must inform us if you wish to cancel a transfer and request a refund in accordance with our refund provisions.
  9. 4.9 Transfer Restrictions. You acknowledge that one year may be added and charged to some domain extensions when transferred. Some domains have maximum registration periods and this may prevent a transfer if the renewal would push the registration over the registry term limit. We will not initiate transfer of a Domain until the order has been placed and fully paid.
  10. 4.10 Expired Domains. If a domain name is not renewed by its expiry date it may cease to operate and enter the applicable registry expiry, grace or redemption process. A Domain may expire if we are unable to obtain payment via the payment method provided, where you have set the Domain to expire, or where you fail to manually renew it before the renewal date.
  11. 4.11 Following the expiry date, a domain may enter a grace and/or redemption period. The applicable process depends on the relevant registry. We may, where permitted by the registry, attempt to renew or restore the Domain, but we are not obliged to do so and cannot guarantee successful recovery.
  12. 4.12 Provided that the relevant registry allows a grace period, you may contact us during that period to request renewal, provided that you pay the renewal fee in full and in cleared funds. On receipt of the applicable renewal fee, we will restore the Domain as soon as reasonably practicable where the registry permits it.
  13. 4.13 Following the end of any applicable grace period, the relevant registry may permit or require auction, release, transfer, deletion or other action in respect of the Domain. We may take such action as is permitted or required by the registry rules.
  14. 4.14 If we do not receive the renewal fee within the applicable grace period, the Domain may enter a redemption period or other registry process. Where redemption is available, you agree to pay the applicable redemption fee(s) plus renewal fee(s) before we make an attempt to recover the Domain. We are not obliged to attempt recovery and cannot guarantee that an attempted renewal or restoration will be successful.
  15. 4.15 .UK Domains (Nominet)
    1. All .UK domain names registered through our Services are managed via Nominet, the official registry for .UK domains. They are subject to Nominet’s Terms and Conditions, Acceptable Use Policy, and any other relevant Nominet rules. By registering a .UK domain, you agree to comply with Nominet’s policies.
    2. We will notify you of your .UK domain registration and expiry dates via the email address held on your account. Renewal reminders will normally be sent at least 30 days before expiry where reasonably practicable.
    3. It is your responsibility to ensure your contact details are accurate and up to date so that you receive these notices.
    4. Failure to renew your .UK domain before expiry may result in loss of registration and any associated services. Nominet may take action in accordance with its policies, including releasing the domain for registration by a third party.

5. HOSTING

  1. 5.1 Free Domain Offer. Some of our hosting packages include a free domain registration or transfer. This applies to a limited number of domain extensions and may vary from time to time. Eligibility and any exclusions will be displayed at the time of order. The registration period is one year. Future renewals of these domains will incur our regular renewal rate unless otherwise stated.
  2. 5.2 Purpose of Services. Unless explicitly stated to the contrary our Services are intended to be used for the purposes of hosting websites and email. Batch processing, video encoding/transcoding, web crawling/spidering, archiving and online backup systems and other activities materially outside ordinary website hosting are not permitted on our shared or reseller hosting servers. Such tools may only be used with our written agreement on a dedicated server. We reserve the right to take reasonable action to maintain the stability and security of our systems for all customers.
  3. 5.3 Suitability of Hosting Environment. Some packages feature an 'unlimited' service, meaning we do not actively limit your account on disk space or bandwidth (or both). However, to ensure system stability, accounts are subject to resource limits designed to ensure no one customer can materially affect the service of others on shared or reseller servers. On dedicated servers, your resources are defined by the package you purchase.
  4. 5.4 'Unlimited' Allowances. Any 'unlimited' allowances are subject to fair use. Where your usage is materially excessive in comparison with normal usage by other customers on our platform, we may advise you to improve website efficiency, configure a CDN, move to a more appropriate service or agree a bespoke solution. Any additional charge will be agreed with you before it is applied unless already provided for by your order or applicable service terms.
  5. 5.5 Service Needs. If we reasonably consider that the service selected or purchased by you does not meet your service needs, we will inform you and advise you of an appropriate service. Where reasonably necessary to protect service stability, security or other customers, we may require an account move to a suitable hosting environment. We will discuss any material change or additional charge with you before applying it unless urgent action is required for security, legal or operational reasons.
  6. 5.6 Migration Service. We offer a free migration service on a best-effort basis. You acknowledge that you are the party most familiar with your website and we cannot know the intricacies of every website we host. We will take reasonable care to move your site files and data, but it is your responsibility to provide suitable access and to check that the site has migrated successfully. We aim to migrate websites within 72 hours, though we do not guarantee a particular timeframe. In some cases we may also migrate email, DNS records and domain names, but we do not warrant that these can be moved successfully or without interruption.
  7. 5.7 Changes to the hosting environment. We may change the hosting environment your website runs in where reasonably necessary. Such changes will normally be made on a like-for-like basis. We may make changes to reflect changes in relevant laws and regulatory requirements, implement technical adjustments and improvements, address security threats, or change location or infrastructure provider. Where a change materially affects your use of the Services, we will provide notice where reasonably practicable.
  8. 5.8 Upstream Providers. You must comply with applicable terms and acceptable-use requirements of our upstream providers where they apply to your use of the Services. We have attempted to incorporate relevant requirements into this Agreement. See Appendix A.
  9. 5.9 CDN and Bandwidth Usage. In some locations where bandwidth prices are high due to relative lack of connectivity or significant fluctuation, we may require you to use a CDN service we provide or another suitable traffic-distribution service. We will reasonably assist with setup.
  10. 5.10 No Guarantee. We make no guarantee to defend your website from a denial-of-service attack unless a specific mitigation service has been offered and agreed. If you believe you may be a DDoS target, we may recommend a specialist mitigation service.
  11. 5.11 Service uptime. We endeavour to provide 99.9 percent service uptime, excluding planned or emergency server maintenance or conditions beyond our reasonable control. Planned maintenance will be communicated through our status page where reasonably practicable and, where appropriate, by email. In the event of a problem with your server, we aim to have a qualified engineer dealing with the problem within 30 minutes of being notified. This is a response target and not a guarantee that the issue will be resolved within 30 minutes.
  12. 5.12 Backups. We take daily backups of websites where our backup system applies and store them offsite, usually in the same geographic region (but not necessarily the same country) as your live server. We may exclude files we consider non-fundamental to the operation of your website, such as error logs, cPanel backups and cache files. Backups are a best-effort service and we do not warrant that they are complete or regular. It is your responsibility to keep backups of your own website and important data.
  13. 5.13 Disruption to Services. We are not responsible for disruption to the Services caused by events outside our reasonable control. We endeavour to choose providers that offer a high level of performance and uptime. If our supply of the Services is disrupted by an event outside our control, we will take reasonable steps to minimise the effect and communicate material disruption where appropriate. We are not responsible for network or hardware issues upstream of us.

6. PROVIDING THE SERVICES

  1. 6.1 Service costs. The costs of the Services will be as displayed to you at the time of order or otherwise agreed with you.
  2. 6.2 When we will provide the Services. We will supply the Services to you until the subscription expires, you end the contract in accordance with clause 10, or we end or withdraw the Services in accordance with clause 12.
  3. 6.3 What will happen if you do not give required information to us. We may require information from you so that we can supply the Services, verify your account or comply with legal, security or technical requirements. If you do not provide reasonably required information within a reasonable time, or provide materially incomplete or incorrect information, we may suspend or end the affected Service where reasonably necessary. We will not be responsible for delay caused by your failure to provide information we reasonably require.
  4. 6.4 Reasons we may suspend or disable the supply of Services to you. We may suspend or restrict a Service where reasonably necessary to:
    1. 6.4.1 deal with technical problems, security incidents or make technical changes;
    2. 6.4.2 update the Service to reflect changes in relevant laws and regulatory requirements;
    3. 6.4.3 make changes requested by you or permitted under this Agreement;
    4. 6.4.4 comply with law, regulation, a court order or a request from a competent authority;
    5. 6.4.5 address a material breach of this Agreement or applicable acceptable-use requirements;
    6. 6.4.6 resolve or respond to a third-party claim or action; or
    7. 6.4.7 protect our systems, other customers or third parties from fraud, abuse, security threats or material financial or legal risk.
  5. 6.5 Your rights if we suspend the supply of Services. Where reasonably practicable, we will contact you before suspending a Service. We may suspend without prior notice where the circumstances are urgent, including where immediate action is reasonably necessary to protect our systems or other customers, comply with law, or prevent fraud or abuse. Where a suspension is not caused by your breach and lasts for more than 24 hours in any 7-day period, we will, where appropriate, adjust the price for the period during which the affected Service is unavailable. If we suspend a Service for more than 120 hours for reasons not caused by your breach, you may contact us to end the affected Service and we will refund any applicable sums paid in advance for the period after termination.
  6. 6.6 We may also suspend supply of the Service if you do not pay. If an amount remains unpaid after its contractual payment due date, we may suspend the affected Service until the outstanding amount has been paid or another payment arrangement has been agreed in writing. Our overdue-account process may include payment reminders, overdue notices and automated suspension. We will normally notify you that suspension is being applied, but a further grace period after the contractual due date is not required unless required by law or expressly agreed by us. We may also charge interest on overdue payments in accordance with clause 14.1. Once payment has been made in accordance with these terms, we will use reasonable endeavours to ensure that the Service is restored within 24 hours.
  7. 6.7 Service suspension. If your Service has been suspended or remains overdue, we may restrict access to the Service and, subject to applicable law and our data-retention obligations, may cease retaining certain operational copies of your data or website. Your website IP address or other technical configuration may change. You remain responsible for maintaining independent backups of important data.

7. YOUR OBLIGATIONS UNDER THE CONTRACT

  1. 7.1 You are responsible for the content on your Account. Customers are responsible for all scripts, data and other objects on their accounts. Abusive scripts are scripts which interfere with our systems and/or the accounts of other customers, cause harm to another computer system or user, or engage in fraudulent activity. Any account found to be the source of abusive scripts may be suspended and investigated, and may be subject to further action under these terms. We will, where necessary, cooperate with the authorities.
  2. 7.2 You must not use the Service for transmission of illegal material. You agree not to upload to your hosting service, send or receive materials that are unlawful or that infringe the rights of others. In particular you:
    1. 7.2.1 must not gain or attempt to gain unauthorised access to computer systems;
    2. 7.2.2 must not send forged or deliberately harmful network traffic, including denial-of-service attacks, worms, viruses or trojans;
    3. 7.2.3 must not operate an open mail relay or participate in unsolicited bulk email;
    4. 7.2.4 must not conduct port scanning or vulnerability testing of remote systems without express permission;
    5. 7.2.5 must take reasonable steps to ensure that your password and login credentials remain confidential.
  3. 7.3 You must not use the Services to send or receive material that infringes copyright, intellectual property, confidentiality, privacy or other rights. If you are in doubt as to the legality of your use, you should take independent legal advice.
  4. 7.4 Open proxy servers are not permitted and may result in immediate suspension or termination of the affected Service.
  5. 7.5 Sites must not contain unlawful hateful material or content which unlawfully incites hatred or violence.
  6. 7.6 Sites must not contain pornography which is unlawful. Lawful adult content is subject to clause 9.5 and any applicable service requirements.
  7. 7.7 Sites must not contain 'warez', copyrighted music or videos, or links to such content unless you have the necessary rights.
  8. 7.8 You are responsible for complying with applicable copyright and intellectual property law in the jurisdictions relevant to your use of the Services.
  9. 7.9 Registration of domain names. You are responsible for ensuring that the registration and use of a domain name will not infringe third-party rights, is not abusive or fraudulent and is not used for an unlawful purpose. You consent to us providing registration details to registries, ICANN where applicable, law enforcement and governmental bodies where required or permitted by law.
  10. 7.10 You agree that when transferring ownership of a registered Domain to another person or registering a Domain on behalf of another person (the 'Transferee'), you will confirm and provide evidence of the Transferee's authority or agreement where reasonably requested.
  11. 7.11 We may decline to transfer ownership of a Domain where Fees attributable to the relevant Services remain outstanding, subject to applicable registry rules and law.
  12. 7.12 If we receive a complaint regarding trademark or brand infringement, we may place a Domain on hold where required or permitted by the applicable registry, dispute-resolution process, settlement agreement or competent authority.
  13. 7.13 Where we receive documentation indicating a genuine dispute concerning a Domain, we may place a registrar or registry hold where permitted and may require evidence that the dispute has been resolved before processing a transfer.
  14. 7.14 We will cooperate with appropriate UK authorities where required by applicable law.

8. ACCEPTABLE EMAIL USAGE

  1. 8.1 We provide the ability to send e-mail using SMTP. This is designed for day-to-day communication needs. Outbound mail may be scanned by our cloud-based spam and security filtering systems.
  2. 8.2 We have a zero-tolerance policy against spam and the sending of bulk, unsolicited e-mail is prohibited. Customers who abuse the email service may have affected Services suspended, terminated or blocked.
  3. 8.3 By purchasing the Services you agree:
    1. 8.3.1 not to send emails that are unlawful, threatening, fraudulent, abusive or otherwise prohibited by law;
    2. 8.3.2 not to send emails likely to cause unlawful harassment or distress, or material that is offensive, obscene, menacing or otherwise unlawful;
    3. 8.3.3 to have a clear opt-out mechanism in marketing communications where required;
    4. 8.3.4 not to send email to recipients who have lawfully opted out where applicable;
    5. 8.3.5 not to use our mail services or network to send unsolicited bulk email;
    6. 8.3.6 not to use our mail services or network with intent to deprive others of service;
    7. 8.3.7 not to use false mail headers or alter headers to conceal the identity of the sender;
    8. 8.3.8 not to use an email address that you are not authorised to use;
    9. 8.3.9 to ensure that any email servers connected to our network and operated by you are not configured as an open relay;
    10. 8.3.10 to take reasonable responsibility for your email reputation and account security; and
    11. 8.3.11 not to take any action that would put you or us in breach of applicable data protection or privacy law.

9. ACCEPTABLE WEB USAGE

  1. 9.1 Web usage includes the use of web space provided with client accounts, web hosting on our servers and the use of web services and space on dedicated servers. We do not routinely monitor customer content except where necessary for security, abuse investigation, legal compliance, service operation or other legitimate purposes. You remain responsible for the content of your website.
  2. 9.2 It is your responsibility to ensure that the content and materials on any website owned or operated by you contain material that you have created or have permission to use.
  3. 9.3 It is your responsibility to resolve disputes involving copyright or intellectual property rights associated with your website or web service. You agree to indemnify JustHostMe against reasonable costs, including reasonable legal costs, arising from third-party claims caused by your unlawful use of the Services or infringement of third-party rights, except to the extent caused by our own breach, negligence or unlawful act.
  4. 9.4 You must not use your website or web service to promote or distribute material or content that is unlawful in any jurisdiction in which you knowingly make it available where that use would expose you or us to material legal risk.
  5. 9.5 Lawful adult content as permitted by applicable law is allowed on our servers, subject to any technical requirements we reasonably impose. If advance notification is required for the relevant Service, we will tell you before the Service is activated.
  6. 9.6 If you are not located in the UK and intend to upload adult content, you must contact us prior to placing an order. We may decline to offer Services where reasonably necessary because of legal, regulatory, technical or operational risk.
  7. 9.7 We may investigate content or activity where potential abuse is brought to our attention and may restrict access to or remove affected content where reasonably necessary to address a breach, comply with law, or protect our systems or other customers. Accounts found to be in material breach may be suspended or terminated in accordance with clause 12.

10. YOUR RIGHTS TO END THE CONTRACT

  1. 10.1 Ending your contract with us as a standard service user. You may terminate a recurring Service by cancelling it before the renewal date through the client area at justhostme.co.uk/portal. Unless different terms apply to the relevant Service, cancellation should be submitted by 11.59pm UK time on the day before renewal. You may also raise a support ticket at least 24 hours before renewal where the client area cannot be used.
  2. 10.2 Ending your contract with us as a dedicated server user. Unless different notice terms were agreed when you ordered the Service, you may terminate a dedicated server Service by giving written notice at least 24 hours before the next billing date. The Service remains payable up to the effective termination date.
  3. 10.3 Refunds of prepaid months. We offer discounted pricing for some prepayments. If you cancel before the end of a prepaid period, you will not normally be entitled to a refund of unused time unless a refund is required by law, expressly provided by the applicable Service terms, or agreed by us. This does not affect statutory consumer rights.
  4. 10.4 Faulty or misdescribed Services. If the Services you have paid for are faulty or misdescribed, you may have legal rights to require the Service to be re-performed, receive a price reduction or end the contract, depending on the circumstances and whether you are a Consumer. You should inform us of the problem and we will respond within a reasonable period. Nothing in these terms limits any statutory rights.
  5. 10.5 28 day money-back guarantee. For eligible JustHostMe shared hosting services, we offer a 28-day money-back guarantee. You must notify us within 28 days of opening the eligible shared hosting account that you wish to cancel. We will refund payments made for the eligible hosting service up to termination, excluding non-refundable domain registration, renewal and transfer charges and any other charges expressly excluded at the time of order. This guarantee does not apply to dedicated server products, domain name registrations, renewals or transfers. This guarantee is additional to statutory rights.
  6. 10.6 Inappropriate or illegal activity. If your account is found to contain unlawful activity or material breach of these terms, the affected Service may be suspended immediately where reasonably necessary. If the breach is capable of remedy, we may give you a reasonable opportunity to remedy it where appropriate. Continued or serious breach may result in termination under clause 12. Any refund will be dealt with in accordance with these terms and applicable law.
  7. 10.7 Processing of refunds. Where a refund is due, we will normally process it within 7 working days of approval, subject to any longer period required by law or a payment provider.
  8. 10.8 Exercising your right to change your mind (Consumer Contracts Regulations 2013). If you are a Consumer entering into a distance contract, you may have a statutory right to cancel within 14 days, subject to the applicable exceptions. If you expressly request that a Service begins during the cancellation period, you may be required to pay for the proportion of the Service supplied before cancellation. Where a Service is fully performed during the cancellation period following your express request and acknowledgement of the consequences, the statutory cancellation right may end when performance is complete. Nothing in these terms removes any cancellation right that cannot lawfully be excluded.

11. HOW TO END THE CONTRACT WITH US (INCLUDING IF YOU HAVE CHANGED YOUR MIND)

  1. 11.1 Tell us you want to end the contract. To end the contract with us, please log into justhostme.co.uk/portal, view the product, and then raise a cancellation request. Please provide the reason for cancellation where requested. If you qualify for a refund under the money-back guarantee under clause 10.5, please request this in the cancellation notes. If you are unable to use the client area, please contact us through an available support channel.

12. OUR RIGHTS TO END THE CONTRACT

  1. 12.1 We may end the contract if you materially breach it. We may terminate an affected Service by written notice if:
    1. 12.1.1 you do not pay an amount when it is due and the amount remains unpaid after any notice or opportunity to remedy that is required by law or expressly provided by these terms;
    2. 12.1.2 you do not, within a reasonable time of us asking for it, provide information that is reasonably necessary for us to provide the Services;
    3. 12.1.3 you materially breach these terms or applicable acceptable-use requirements and, where the breach is capable of remedy, fail to remedy it within a reasonable period after being asked to do so; or
    4. 12.1.4 immediate termination is reasonably necessary because of unlawful activity, serious security risk, fraud, or a legal or regulatory requirement.
  2. 12.2 Consequences of termination for breach. Where we terminate a Service because of your material breach, you remain liable for amounts properly due up to the termination date and any other reasonable sums recoverable under these terms or applicable law. Where we have received payment in advance for Services that we do not provide because we terminate for reasons other than your breach, we will refund the applicable unused amount unless otherwise stated or required by law.
  3. 12.3 We may withdraw the Services. We may write to you to let you know that we are going to stop providing a Service. We will normally give you at least 30 days' advance notice and will refund any sums you have paid in advance for Services that will not be provided. A shorter period may apply where reasonably necessary because of legal, regulatory, security, technical or other circumstances outside our reasonable control.

13. PRICE AND PAYMENT

  1. 13.1 Where to find the price for the Service. The price of the Service will normally be the price indicated on the order pages when you place your order. Where VAT is applicable it will be shown or otherwise accounted for as required by law.
  2. 13.2 We will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date we supply the Service, we may adjust the VAT charged to reflect the applicable legal rate, subject to any mandatory consumer rights.
  3. 13.3 Changes in the price. We may alter prices advertised on our website for new orders at any time. For existing recurring Services, a price change will normally take effect from the next renewal or billing period after reasonable notice has been given. If your contract is for a fixed term, the price alteration will take effect at the end of the current term and at renewal unless otherwise agreed.
  4. 13.4 What happens if we got the price wrong? If we discover that a Service was advertised at an incorrect price, we will correct the price. If the correct price is lower than the amount you have been charged, we will refund the difference. If the correct price is higher, we will contact you before accepting the order or, where the order has already been accepted and applicable law permits, give you the option to pay the correct price or cancel the affected order.
  5. 13.5 When you must pay and how you must pay. We accept payment by the methods made available to you, which may include major credit and debit cards, direct debit, bank transfer and cheque. You warrant that you are lawfully authorised to make a payment using the payment method or facility used. If you use a payment method belonging to another person or organisation, you confirm that you have the necessary authority to do so.
  6. 13.6 Stored payment methods and automatic collection. Where you save a payment card through our client area or make a card payment that results in a payment method being stored on your account, we may securely retain a payment-method reference through our payment provider and use that payment method to collect amounts that become due under your account, including recurring service charges, renewals and invoices. Where a payment method is stored, we may attempt to collect payment up to 7 days before the contractual payment due date stated on an invoice in order to prevent service interruption. We will not store full card details on our own systems where the payment provider processes and stores those details. You can remove or update a stored payment method through the client area where that functionality is available. If you remove a stored card, you remain responsible for paying invoices by another available payment method by the applicable due date.
  7. 13.7 When payment is due. Payment terms depend on the Service ordered. Unless different terms are expressly stated at the time of order or on the applicable invoice:
    1. 13.7.1 initial orders are payable when the order is placed;
    2. 13.7.2 recurring Services are billed in advance for the relevant subscription or billing period;
    3. 13.7.3 the payment due date shown on an invoice is the contractual payment date for that invoice; and
    4. 13.7.4 one-off charges, additional Services and other amounts are payable by the due date stated on the relevant invoice or order.
  8. 13.8 Invoices will be sent in advance of payment due. Invoices will be sent to the email address provided by you when registering your account and made available through the client area where applicable. You can view your email history and invoices in justhostme.co.uk/portal.
  9. 13.9 What to do if you think an invoice is wrong. If you think an invoice is wrong, please contact us promptly and identify the amount and reason for the dispute. We will review genuine billing disputes. Unless we agree otherwise or applicable law provides otherwise, undisputed amounts remain payable by their due date.

14. LATE PAYMENT AND CHARGEBACKS

  1. 14.1 Late payment. If an invoice remains unpaid for 7 days after its contractual payment due date, we may apply a £5 late payment administration fee to the account. We will not apply this fee to an amount that is genuinely disputed in accordance with clause 13.9 while that dispute is being investigated. We also reserve the right to charge interest on overdue amounts at the rate of 4 percent a year above the base rate of the Bank of England from time to time, calculated daily from the contractual payment due date until payment is received, subject to any applicable legal restrictions. Nothing in these terms excludes or limits any statutory right to interest, compensation or recovery costs that cannot lawfully be excluded or limited.
  2. 14.2 Invoice disputes. We will not charge contractual interest on an amount that we agree is genuinely disputed while the dispute is being investigated. If the dispute is resolved in our favour and the amount is confirmed as properly due, interest may be charged from the original due date unless applicable law prevents this.
  3. 14.3 Chargebacks and payment reversals. If a payment is reversed, charged back or otherwise withdrawn and the reversal is not justified by the circumstances of the transaction, the underlying amount remains due. We may suspend affected Services until the amount has been repaid. We may also recover reasonable costs actually incurred as a result of an unjustified payment reversal, to the extent permitted by law and subject to any applicable consumer rights.

15. OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU

  1. 15.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result of that failure, subject to the limitations in this clause. Loss or damage is foreseeable if it is an obvious consequence or was reasonably within the contemplation of both parties when the contract was made.
  2. 15.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any other liability that cannot lawfully be excluded or limited.
  3. 15.3 Subject to clause 15.2 and any rights you have under applicable law, we are not responsible for indirect or consequential loss arising from interruption, suspension, unavailability or failure of a Service, or from loss or corruption of data, where such loss is not a foreseeable direct loss caused by our breach or negligence. You are responsible for maintaining independent backups of important data.
  4. 15.4 We are not liable for business losses. If you use the Services for business, commercial or resale purposes, and subject to any liability that cannot lawfully be excluded or limited, we will not be liable for indirect or consequential loss of profit, revenue, business, business opportunity or anticipated savings, or for business interruption.
  5. 15.5 Limit of liability. Subject to clauses 15.2 to 15.4 and except where you are a Consumer or applicable law requires otherwise, our aggregate liability arising out of or in connection with a Service will not exceed twice the fees paid by you for the affected Service during the 12 months preceding the event giving rise to the claim.
  6. 15.6 Consumer rights. If you are a Consumer, nothing in these terms is intended to exclude or restrict your statutory rights or remedies, including rights arising under the Consumer Rights Act 2015 or other applicable consumer legislation.

16. HOW WE MAY USE YOUR PERSONAL INFORMATION

  1. 16.1 How we may use your personal information. We will process personal data in accordance with our Privacy Policy and applicable data protection law.
  2. 16.2 Customer data. Where, in providing the Services, we process personal data on your behalf as a processor, the processing will be governed by our Data Processing Agreement, applicable data protection law and these Terms of Service. The Data Processing Agreement forms part of our Agreement with you where we process personal data on your behalf as a processor.

17. OTHER IMPORTANT TERMS

  1. 17.1 We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation as part of a sale, restructuring, merger, acquisition or transfer of part of our business, provided that the transfer does not reduce your legal rights. We will notify you where required by law.
  2. 17.2 You need our consent to transfer your rights to someone else. You may only transfer your rights or obligations under these terms to another person if we agree to this in writing, except where applicable law gives you a right to do so. Transfer requests can be made via support ticket in justhostme.co.uk/portal.
  3. 17.3 Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms, except where applicable law provides otherwise.
  4. 17.4 If a court finds part of this contract illegal, the rest will continue in force. Each provision operates separately. If any court or relevant authority decides that any provision is unlawful, invalid or unenforceable, that provision will be modified or removed to the minimum extent necessary and the remaining provisions will remain in full force and effect.
  5. 17.5 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and will not prevent us from taking steps at a later date.
  6. 17.6 Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by the law of England and Wales. Subject to any mandatory rights available to you, the courts of England and Wales will have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of Scotland or Northern Ireland where permitted by applicable law.
